The most common type of requests that are received as part of Court of Protection proceedings are Section 49 reports (professional reports), access to information, and requests for the Trust to join as a party to ongoing proceedings. Requests usually are made informally, followed by a court order.
Please ensure that all requests are shared with the MCA Team promptly upon receipt of the initial communication from solicitors. Alongside monitoring the requests received, the Mental Capacity Act team will be able to liaise with solicitors on behalf of the Trust to negotiate timescales, identify a nominated professional to complete the report, or any additional matters.
